An employee who has violated U. S. Federal DOT drug and alcohol regulations by testing positive for alcohol or drugs or refusing to be tested, must be immediately removed from his or her DOT safety-sensitive duties and must successfully complete a comprehensive DOT SAP evaluation and a mandatory education or treatment program.
Any employer who allows an employee with a DOT violation to continue performing safety-sensitive duties is subject to fines up to $10,000 or more a day.
