With that safety priority in mind, DOT describes the Substance Abuse Professional (SAP) as being a qualified professional who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

Accordingly, employees who hold safety-sensitive positions in the following six (6) industries are subject to federal drug and alcohol use and testing requirements:

  • Federal Aviation Administration (FAA)
  • Federal Motor Carrier Safety Administration (FMCSA)
  • Federal Railroad Administration (FRA)
  • Federal Transit Administratiojn (FTA)
  • Pipeline and Hazardous Materials Safety Administration (PHMSA)
  • United States Coast Guard (USCG)

  • Annually, 88,000 deaths are attributed to excessive alcohol use alone, making it the 3rd leading lifestyle-related cause of death in the nation.
  • Excessive alcohol consumption is responsible for a loss of 2.5 million years of potential life annually.
  • Up to 40% of all hospital beds in the United States, excluding maternity and intensive care units, are occupied by individuals with health conditions stemming from substance use. *

About two-thirds of adults in the U.S. with an alcohol or substance use disorder have a job, according to the Centers for Disease Control and Prevention. Importantly, employees are more likely to undergo treatment if it is initiated by an employer.**

The Return-to-Duty Process:

An employee who has violated U. S. Federal DOT drug and alcohol regulations by testing positive for alcohol or drugs or refusing to be tested, must be immediately removed from his or her DOT safety-sensitive duties and must successfully complete a comprehensive DOT SAP evaluation and a mandatory education or treatment program.

Any employer who allows an employee with a DOT violation to continue performing safety-sensitive duties is subject to fines up to $10,000 or more a day.
